By accessing the Website, purchasing Products, or using Services, you agree to these Terms of Service (“Terms” or “Agreement”). Arbitration Agreement: Opt-out and general contact methods have been removed. Arbitration administrators include recognised organisations such as ADR Services and NAM. Governing law remains under California jurisdiction (specific county to be determined). Jurisdiction-Specific Clauses: The limitation of liability disclaimer excludes New Jersey as retained from the original template. Brand Alignment: All original references rebranded to Dada Boss throughout. CORE TERMS 1. User Obligations Users must be at least 18 years old or the legal age of majority in their jurisdiction. Users must provide accurate and truthful information. Misuse of the Website, including unauthorized access or account sharing, is prohibited. ARBITRATION AGREEMENT Binding Individual Arbitration All disputes must be resolved through individual arbitration, not in court. Users waive their rights to participate in class action lawsuits and jury trials. Opting out of arbitration terms must be done within 30 days of agreement acceptance. Arbitration Process Users must first attempt to resolve issues informally within 60 days. Arbitration will be administered by an approved third-party arbitrator (e.g., ADR Services or NAM). For large-scale claims, batching may apply (20+ for ADR; 25+ for NAM). Governing Law & Venue The Federal Arbitration Act applies. If a dispute is not subject to arbitration, it will be resolved in courts within the specified state jurisdiction. OTHER PROVISIONS Severability: If any part of the Arbitration Agreement is found unenforceable, the remainder may also be deemed void. Survival: Arbitration and other legal provisions remain enforceable after account termination or agreement expiration.
